Portland Glass – Rewards Promotion Official Terms and Conditions

THE FOLLOWING PROMOTION (“Promotion”) IS INTENDED FOR STATES IN WHICH GLASS OPERATING LLC d/b/a Portland Glass (“Portland Glass”) OPERATES (COLLECTIVELY, THE "ELIGIBILITY AREA"). DO NOT PARTICIPATE IN THIS PROMOTION IF YOU ARE NOT LOCATED IN, AND A LEGAL RESIDENT OF, THE ELIGIBILITY AREA AT THE TIME OF THE PROMOTION.YOUR PARTICIPATION IN THIS PROMOTION CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL TERMS.

1. Eligibility: The Promotion is open to individuals who receive a direct-mail promotional communication from Portland Glass ("Recipients") and who are legal residents of the United States and are 18 years of age or older at the time of participation. Employees, officers, directors, and agents of Portland Glass, as well as their immediate family Recipients and those living in the same household, are not eligible to participate.

About the Promotion: Portland Glass is providing exclusive promotional offers on certain products and services to the Recipients. The Promotion:

Promotion Period: The Portland Glass promotional offer ("Promotion") is valid from [05/01/2026 through 12/31/2026 ("Promotion Period").
Promotional Offer Details: During the Promotion Period, Recipients who complete the form at the following link https://www.portlandglass.com/mailers1/ will be eligible for the following exclusive offers:
1. Vinyl windows starting at $699 purchased through Portland Glass.
2. Frameless shower enclosures starting at $1,899 purchased through Portland Glass.
3. Free windshield wipers with any windshield replacement order placed with deposit or full payment.
How to Participate: To receive the promotional offer, Recipients must complete the form linked above. The form must be filled out completely and accurately with all required information. Once the form is submitted, participants will receive instructions on how to redeem their exclusive offers from Portland Glass. Offers must be redeemed within the Promotion Period to be valid.
Limitations: Each Recipient is limited to one redemption per offer type (vinyl window purchase, glass shower enclosure purchase, windshield replacement order) during the Promotion Period. The promotional offer cannot be combined with any other discounts, promotions, or special offers unless by written consent by Portland Glass.
General Conditions: Portland Glass reserves the right to modify, suspend, or terminate the Promotion at any time without prior notice. By participating in the Promotion, Recipients agree to be bound by these Terms and Conditions and all decisions of Portland Glass, which are final and binding. Portland Glass is not responsible for any lost, late, incomplete, illegible, or misdirected submissions or for any technical or human error that may occur in the administration of the Promotion. Recipients agree to release and hold harmless Portland Glass, its affiliates, and their respective officers, directors, employees, and agents from and against any claims arising out of or related to their participation in the Promotion or acceptance, use, or misuse of any promotional offer. This Promotion is subject to the laws of the United States, including all applicable federal, state and local laws and regulations. By participating, Recipients: (a) release and hold harmless Portland Glass, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from participation in this Promotion.
Limitations of Liability: Portland Glass assumes no responsibility or liability for lost, late, misdirected, incomplete, jumbled, garbled, or scrambled submissions or communications, or for theft, destruction, or unauthorized access to, submissions or communications. Portland Glass assume no responsibility for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Promotion. Portland Glass assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, effects of hackers, software, email, or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing, that may occur (including but not limited to any such problems which may result in the ability to access or to process any transaction(s) in connection with the Promotion). Portland Glass assume no responsibility for any injury or damage to Recipients or to any computer related to or resulting from participating in this Promotion. If, for any reason, the Promotion, or any of its respective components is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures of any kind, whether human, mechanical, or electronic, or any other causes beyond the control of Portland Glass which corrupt or affect the administration, security, fairness, integrity or proper conduct of the this Promotion, Portland Glass reserves the right at its sole discretion to cancel, terminate, modify or suspend this Promotion, or the affected component thereof
Disputes: Except where prohibited, Recipients agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, and exclusively by the state and federal courts of McLennan County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will Recipient be permitted to obtain awards for, and Recipient hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Recipient and Portland Glass in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
1. CLASS ACTION WAIVER. COURT PROCEEDINGS HELD UNDER THESE TERMS AND CONDITIONS CANNOT BE BROUGHT, MAINTAINED OR RESOLVED ON BEHALF OF OR BY A CLASS, AS A PRIVATE ATTORNEY-GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY. IN ADDITION, INDIVIDUAL PROCEEDINGS CANNOT BE COMBINED WITHOUT THE CONSENT OF ALL OF THE PARTIES. ANY QUESTION REGARDING THE ENFORCEABILITY OR INTERPRETATION OF THIS PARAGRAPH WILL BE DECIDED BY A COURT.
JURY TRIAL WAIVER. RECIPIENT AND PORTLAND GLASS AGREE THAT THERE WILL NOT BE A JURY TRIAL. RECIPIENT AND PORTLAND GLASS UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, PROCEEDING OR COUNTERCLAIM IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS. IN THE EVENT OF LITIGATION, THIS PARAGRAPH MAY BE FILED TO SHOW A WRITTEN CONSENT TO A TRIAL BY THE COURT.
Choice of Law. These Terms and Conditions and the relationship between the parties, including any claim or dispute that might arise between the parties, whether sounding in contract, tort, or otherwise, will be governed by the laws of the State of Texas without regard to its conflict of law provisions. In no event will the parties bring claims against one another under the laws of another jurisdiction.

By participating in the Promotion, you grant Portland Glass permission to use your email address and any other personally identifiable information.
